Introduction and Agreement:

Harvested Financial LLC (“Harvested Financial”), together with its members, officers, directors, owners, employees, agents, representatives, suppliers, and service providers (collectively, “Harvested” or “we”), provide information, materials, services, and other content (collectively the “Content”) via this website (https://www.harvestedfinancial.com) and other internet platforms (such as https://thetape.report, https://www.demothetape.com, https://thetill.substack.com, https://thetape.substack.com, or https://thetapeportfolio.substack.com), which are referred to collectively as the "Website" or the "Site." Use of and access to the Website and the Content is for information purposes only and is subject to these terms of use and all applicable laws.

Harvested Financial is a registered investment advisor (RIA) under the Investment Advisers Act. But use or access of the Site or the Content does not create a fiduciary relationship, unless or until you execute a written agreement to retain Harvested Financial as your RIA.

Use of and access to the Website and Content is subject to these Terms and Conditions and all applicable laws. Except where advisory services are provided to Clients under a separate written Client Agreement, the Website and Content are provided for informational purposes only.

For the avoidance of doubt, purchasing or subscribing to analytics, research, data, or other non-advisory products or services through the Website does not create an advisory, fiduciary, or client relationship with Harvested Financial.

Harvested Financial provides informational content, analytics, research, and data services through the Website, and provides investment advisory services only to Clients under a separate written advisory agreement. By accessing the Website and the Content, you agree to and accept these Terms and Conditions, as well as our Privacy Policy which governs the collection and use of personal information. These terms/policies may be updated periodically, and you can find the most up-to-date versions on our Website.

If a Client Agreement conflicts with these Terms and Conditions, the Client Agreement controls with respect to advisory services provided to that Client.

Privacy:

Our Privacy Policy (https://www.harvestedfinancial.com/privacy-policy) describes how we handle the information you provide to us when you access our Site and Content. You understand that through your use of the Content you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer of this information to the United States for storage, processing and use by us and our affiliates.

Users, Visitors, Customers, and Clients:

Visitors are individuals or entities who access, browse, or view the Website or Content, whether or not they create an account or purchase anything.

Customers are individuals or entities who purchase or subscribe to Harvested Financial’s analytics, research, educational, or data-related products or services through the Website, but who have not entered into a written advisory agreement with Harvested Financial. Customers are not advisory clients and do not receive personalized investment advice, recommendations, or fiduciary services through such subscription or purchase.

Clients are individuals or entities who have entered into a separate written advisory agreement with Harvested Financial for investment advisory services. Only Clients receive investment advice from Harvested Financial, and any such advice is provided solely under the terms of the applicable written advisory agreement.

A Client may also purchase or subscribe to non-advisory products or services as a Customer, but any advisory relationship exists only under the separate written Client Agreement.

For purposes of these Terms and Conditions, all Visitors, Customers, and Clients who access the Website are collectively referred to as “Users,” except where a section specifically distinguishes among them.

Website Usage:

The Website and its content are intended exclusively for adults aged 18 years and older. Use and access implies that you are over the age of 18, and use by any minor is unauthorized.

This Website is also intended only for residents of the United States. Our Terms and Conditions as well as Privacy Policy may or may not abide by the laws of other jurisdictions and we make no representation that it does.

The public portions of the Website and Content are provided for informational, educational, and research purposes only. Content made available to Customers through paid subscriptions or purchases is likewise informational and analytical in nature only, and does not constitute personalized investment advice, a recommendation, or a solicitation to buy, sell, or hold any security or strategy. Visitors and Customers remain solely responsible for their own financial, investment, legal, and tax decisions. Only Clients who have signed a written advisory agreement with Harvested Financial may receive investment advice from Harvested Financial, and only pursuant to the terms of that agreement.

Clients who engage Harvested Financial will sign the Client Agreement and be bound by those terms. Certain portions of the Website may be available only to registered Users. Customers may receive access to subscription-only analytics, research, or data features. Clients may receive access to separate portal features related to advisory services, subject to their written Client Agreement.

The Website is only to be used for its intended purposes. Any misuse or tampering with features is explicitly prohibited. Operating the Website in a manner which is intended to expose bugs, security flaws or other technical structures is prohibited. The use of tools, automated or manual, to extract any content from the Website is prohibited. The Website may not be used for any commercial purposes.

Ownership:

The content on this Website is owned exclusively by Harvested Financial or licensed for use herein.

Access:

Access to the Website is conditional and may be revoked at any time for any reason at the sole discretion of Harvested Financial. Use of the Website is governed by these Terms and Conditions and the Privacy Policy.

Harvested Financial reserves the right to suspend, restrict, or terminate any account or access to paid or unpaid features for any violation of these Terms and Conditions or for any other lawful reason.

Users, including Visitors, Customers, and Clients, may create an account to access certain features or areas of the Website. This password must be safeguarded at all times and not disclosed to third parties. If there is any suspected information leakage Users should immediately contact Harvested Financial or change their password. Personal details provided during registration are warranted by the user to be accurate.

Billing; Recurring Subscriptions; Auto-Renewal:

Certain products or services made available to Customers through the Website may be offered on a subscription basis and billed on a recurring basis. By purchasing a subscription, you authorize Harvested Financial, or its third-party payment processor, to charge the payment method you provide at the stated interval (for example, monthly or annually) until you cancel.

Unless otherwise expressly stated at the time of purchase, subscriptions automatically renew at the end of each billing period at the then-current rate using the payment method on file. By enrolling in a subscription, you agree to this automatic renewal feature and recurring billing until cancellation.

You are responsible for any applicable taxes, fees, or charges imposed in connection with your subscription or payment method.

Upon cancellation, you will continue to have access through the end of the then-current billing period unless otherwise stated at the time of purchase.

You are responsible for maintaining current, complete, and accurate billing and payment information. If a payment method fails, is declined, or cannot be processed, Harvested Financial may suspend or terminate access to the applicable subscription service until payment is successfully processed.

You may cancel a subscription at any time through your account settings, if available, or by contacting Harvested Financial. Unless otherwise stated at the time of purchase, cancellation will take effect at the end of the current billing period, and fees already paid are non-refundable. Harvested Financial reserves the right to change subscription fees or billing terms upon prior notice posted on the Website or sent to the email address associated with your account.

Failure to cancel before the renewal date will result in the subscription renewing for the next billing period and the applicable renewal charge being applied automatically.

Limitation of Liability:

All use of the Website and any Personal Information provided is done so at the sole discretion and responsibility of the User. All information, materials, and content provided here is done on an AS IS basis, and conveys no warranty of any kind. This limitation will be present to the fullest extent of the law. Harvested Financial explicitly disclaims any liability to update this information or guarantee accuracy. Harvested Financial shall not be liable for any claims that result from the inability to access the Website.

HARVESTED FINANCIAL AND ITS EMPLOYEES, DIRECTORS, AND AGENTS EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES OF ANY KIND. WHETHER THEY ARE EXPRESS, IMPLIED, OR STATUTORY, RELATING TO HARVESTED FINANCIAL’S WEBSITE, CONTENT, AND/OR USER INFORMATION, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY, TITLE, SECURITY, ACCURACY, COMPLETENESS, FITNESS FOR A PARTICULAR PURPOSE, OR NON INFRINGEMENT. THIS LIMITATION APPLIES WHETHER THE CONSEQUENCES WERE FORESEEABLE BY HARVESTED FINANCIAL OR NOT.

You agree to indemnify and hold harmless Harvested Financial for any liability, loss, claim, or expense related to your use of the Website. This includes attorney fees. Nothing is intended to waive any non waivable rights which are statutorily available to you.

Harvested Financial does not guarantee that the Website or any subscription feature will be available at all times, uninterrupted, secure, or error-free.

Rules of Engagement:

So long as the User is making use of the Website and other properties of Harvested Financial, they agree to the following:

Users will not share passwords
Users will behave and use the services in a lawful and non-abusive manner
Users will truthfully answer and complete questionnaires
Use is strictly personal

Security:

Technological misuse of the Website is explicitly prohibited. This includes all types of tampering, use of malware, virus spreading, intended or unintended breaches of security, and attempts to disrupt protocols. Any act which might be construed as modifying the functioning of the Website for anything but its explicit use cases is forbidden.

Harvested Financial provides investment advisory services only to Clients who have entered into a separate written Client Agreement with Harvested Financial. Only Clients may receive investment advice, including advice delivered through digital tools, portals, communications, reports, or other features made available through the Site, and any such advice is provided solely under the terms of the applicable Client Agreement. Advisory services will be performed only in jurisdictions where Harvested Financial is registered or exempt from registration.

Harvested Financial is a registered investment adviser in the State of Connecticut. Registration does not imply any level of skill, training, certification, or endorsement.

Past performance does not indicate future results. Harvested Financial makes no guarantees to Users regarding the performance of any investment product, strategy, or account. Different investment strategies involve different risks, and all investing involves risk, including the possible loss of principal.

While the Site may include discussion of trading strategies, market activity, analytics, model outputs, or historical results, nothing on the Site is intended as an offer to purchase or sell securities, or as a recommendation of any investment, strategy, or transaction for any Customer or Visitor. All Users remain responsible for independently evaluating information made available through the Website. Before acting on any autonomously generated or compiled content, Users should review the relevant information carefully and, where appropriate, consult directly with a qualified professional.

Waivers:

If any of the provisions contained herein are determined to be illegal or unwaivable, that specific waiver will be enforced to the fullest extent possible, and is severable from other waivers which will be enforced to the fullest extent possible.

Users of Harvested Financial’s Website may not assign their rights and agreement to any third party. Harvested Financial may assign these Terms and Conditions to another entity without the express consent of users.

Users agree to waive all rights to a class action proceeding to the fullest extent permitted by law. No proceeding shall be joined with another, there is no right for the dispute to be arbitrated on a class basis, and there is no authority to bring disputes on behalf of the general public. Claims may only be brought in an individual capacity.

Any content that is submitted to Harvested Financial in the form of suggestions or product features becomes the property of Harvested Financial. To the extent that these ideas become incorporated into future products, including this Website, you waive all rights and claims to the intellectual property or other associated rights.
